Ontario Divorce Requirements

A married couple is eligible to be divorced in Ontario after they have been separated for a year, or if one of the spouses engaged in a sexual relationship with another partner or exhibited physical or mental cruelty toward the other spouse.

Both spouses have an equal right to stay in the family home under Ontario family law, even if the house is only titled in one spouse’s name. The spouses will have to decide between themselves who will leave, or the court may decide for them. When there are children from the marriage, the custodial parent most often gets possession of the home, but not always.

The main issues typically to be decided in a divorce include child custody, child support, spousal support and property division. If the spouses can agree on these matters between themselves, the court will generally approve a written agreement drawn up by the parties and reviewed by each party’s lawyer. If any issues are contested, the court will hold hearings to decide the outcome of these important matters based on the evidence and arguments presented by the lawyers.
